Photo Whisper AI — Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using Photo Whisper AI (the "App"). It's part of our Terms of Service — by using the App you agree to follow this AUP. If you break these rules, we may remove content, suspend or terminate your account, and, where required by law, cooperate with authorities.

1. What you must not upload or generate

You must not use the App to create, upload, or attempt to generate:

  • Sexual content involving minors — any imagery that depicts, sexualises, or appears to depict minors in a sexual or suggestive manner. This is illegal everywhere and will result in immediate account termination and reporting to authorities.
  • Explicit sexual or pornographic content, whether real or AI-generated.
  • Non-consensual intimate imagery — including "deepfake" or AI-generated nudity of real people without their explicit consent.
  • Content depicting or glorifying extreme violence, gore, or graphic injury.
  • Content that promotes or encourages self-harm, suicide, or eating disorders.
  • Hate symbols, hate speech, or content that promotes discrimination against a person or group based on race, ethnicity, religion, nationality, gender, sexual orientation, disability, or similar characteristics.
  • Content that depicts, promotes, or facilitates illegal activity — including terrorism, human trafficking, drug trafficking, weapon manufacture, or fraud.
  • Content that infringes someone else's rights — including copyrighted works you don't have rights to use, trademarks, likenesses of real people without consent, and confidential or private information.
  • Malware, viruses, or harmful code of any kind.

We run automated safety checks on every generation request to help prevent content in these categories. If the check blocks your request, the generation will not proceed.

2. Real people in images

If you upload an image that depicts a real person:

  • You must be that person, or
  • You must have that person's clear permission to upload their image and use it with AI generation.

This applies to faces, bodies, and any identifiable features. Uploading images of people without their consent is a violation of this AUP regardless of what you do with the result.

Special caution for minors: Photo Whisper is rated 13+, so some users are themselves minors. Whatever your age, don't upload images of anyone under 18 — other than yourself — unless you are their parent or legal guardian, and even then, don't use those images for anything that could sexualise them, expose their identity in harmful ways, or put them at risk. If you are under 18, do not upload images of other people, and never share personal information about yourself or others in prompts.

3. Child safety

We have a zero-tolerance policy for child sexual abuse and exploitation (CSAE), including any AI-generated material that sexualises or exploits a minor. It is never allowed on Photo Whisper, and it is illegal.

To keep children safe, we:

  • Prohibit any content that sexualises, exploits, or endangers a minor (see Section 1). Photo Whisper is not for children under 13, and you must not upload images of anyone under 18 except as described in Section 2.
  • Screen every generation request with an automated safety check designed to block this content before it is produced.
  • Provide reporting for everyone: use the "Report" option in the App (it lists "Sexual content involving minors" first), or email abuse.photowhisperai@ezalabs.io, our contact point for child-safety matters.
  • Act on what we find: we remove violating content, terminate the responsible account, and notify the competent authorities where the law requires.

If you believe a child is in immediate danger, contact your local law-enforcement authorities right away.

4. How you must not use the App

You must not:

  • Automate or scrape the App — no bots, scripts, crawlers, or automated tools against our API or the App, except where we explicitly offer one.
  • Circumvent or tamper with our technical protections, including our safety checks, rate limits, subscription controls, or credit system.
  • Resell or sublicense the App as a service to third parties without our written permission.
  • Reverse engineer or copy the App's code, except to the extent this right is granted by mandatory law.
  • Impersonate another person or entity in your account, your prompts, or your generated content.
  • Interfere with other users — including harassment, abuse, or attempts to access other users' accounts or content.
  • Use the App for any illegal purpose under the law of your country or the country where your content is used.

5. Intellectual property

You're responsible for making sure you have the right to upload anything you upload:

  • If you upload a photo you didn't take, you must have permission from the photographer or rights-holder.
  • If you upload artwork, designs, or characters someone else created, you must have permission.
  • Uploading copyrighted content without the right to do so is a violation of this AUP, even if the output you generate is different from the input.

You are solely responsible for how you use the outputs of the App. If your use of an output infringes someone else's rights, that's on you, not us. We explain this in more detail in the Terms of Service.

6. Reporting violations

If you see content in the App that violates this AUP, or if you believe content generated by the App infringes your rights or breaks the law:

  • Inside the App: use the "Report" button on any output.
  • By email: write to abuse.photowhisperai@ezalabs.io.

To help us act quickly, your report should include:

  • A clear explanation of why you believe the content is illegal or violates our rules.
  • A specific identifier or description of the content (such as a generation ID, share link, or screenshot).
  • Your contact details.
  • For intellectual-property complaints: which right you hold (e.g., copyright, trademark) and a statement that you're either the rights-holder or authorised to act on their behalf.
  • A statement that the information in the report is, to the best of your knowledge, accurate and submitted in good faith.

We handle reports in accordance with applicable law, including the EU Digital Services Act, and we act on valid notices in a timely and diligent manner. We may ask you for more information if your report is incomplete.

7. What happens if you break the rules

Depending on severity, we may:

  • Block a single request — the most common outcome, handled automatically by our safety checks.
  • Remove specific content from our systems.
  • Warn you and give you a chance to comply.
  • Suspend your account — temporarily or pending investigation.
  • Terminate your account permanently — for serious or repeated violations, or any violation involving child safety or illegal content.
  • Cooperate with law enforcement — where required by law (for example, reporting child sexual abuse material, or responding to a court order).

Account-level actions — suspending or terminating your account — and removing content you've stored are reviewed by a person before they take effect; they are not decided by automated means alone. When we suspend or terminate your account or remove your stored content, we'll give you a brief statement of the reason, unless the law prevents us or doing so would compromise an investigation or someone's safety (for example, in matters involving child safety or illegal content). Per-request blocks by our automated safety check are not individually explained, to avoid helping bad actors evade the check.

To the extent permitted by applicable law, you won't receive a refund for credits or unused subscription time if your account is terminated for violating this AUP. Refunds for paid products are handled by Apple or Google under their policies — see our Terms of Service for details.

8. Changes to this AUP

We may update this AUP to reflect changes in the App, in the law, or in our safety practices. When we make meaningful changes, we'll let you know by email or through an in-app notice before the change takes effect — unless the change is needed to comply with law, in which case we may need to move faster.
